Privacy Policy
Effective Date: July 20, 2026
Last Updated: July 20, 2026
Entity: SuperQ Quantum ("SuperQ", "we", "our", or "us")
Introduction
Welcome to Super™ ("Platform"), an AI-powered quantum and classical computing platform operated by SuperQ Quantum. We respect your privacy and are committed to protecting your personal data and proprietary enterprise workflows.
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, APIs, ChatQLM interface, and agentic optimization services. This policy applies globally and aligns with international data protection and AI governance standards, including the EU Artificial Intelligence Act (EU AI Act), the General Data Protection Regulation (GDPR / UK GDPR), the California Consumer Privacy Act (CCPA / CPRA), and Canadian PIPEDA.
1. Information We Collect
We collect several types of information from and about users of our platform:
-
Personal Data: Identifiable information such as your name, business email address, job title, employer, billing details, and location when you register or subscribe.
-
Profile Data: Information provided in your user profile, including technical skill domains, computing preferences, and organizational role.
-
Usage & Telemetry Data: Information about how you interact with our platform, including session duration, resource utilization (quantum vs. classical solver execution time), API call volume, and system diagnostic logs.
-
Chat, Prompt, and Computing Data: Natural language inputs, mathematical formulations, constraint definitions, code scripts (e.g., Python, QASM), and computational results submitted to or generated by our AI agentic layers and optimization solvers.
2. How We Use Your Information
We use the information we collect for specific operational and technical purposes:
-
Providing, operating, and maintaining our AI agentic interfaces and classical/quantum computing solvers.
-
Personalizing your experience and managing user accounts.
-
Processing and completing commercial transactions.
-
Maintaining platform security, detecting prompt injection attempts, and preventing unauthorized system access.
-
Communicating critical platform updates, security alerts, and technical support responses.
-
Complying with statutory legal, accounting, and regulatory obligations.
3. AI Data Governance & Model Training Policies
We maintain a strict distinction between user subscription tiers regarding data retention and AI model training:
A. Enterprise & Commercial Tenants (Zero-Retention Standard)
-
Zero AI Model Training: For Enterprise and paid commercial tenants, SuperQ operates a Zero-Retention Processing Architecture. Your natural language prompts, structured problem formulations, operational datasets, and generated code scripts are never used to train, retrain, or fine-tune our localized AI models, agents, or quantum heuristics.
-
In-Memory Processing: Operational input data submitted to ChatQLM or our problem-framing agents is processed strictly in-transit (in-memory) to execute optimization requests and deliver results.
B. Free and Beta Tier Users
For non-enterprise users on Free or Beta testing tiers, anonymized and de-identified conversation logs may be used to evaluate translation accuracy, improve agentic problem-framing heuristics, and optimize computing performance. Personal identifiers are stripped prior to system optimization usage. Non-enterprise users may opt out of data usage for platform improvement by contacting support@superq.co.
4. AI & Computing Privacy Considerations
As a platform utilizing Large Language Models (LLMs), agentic translation workflows, and high-performance computing resources, we adhere to the following privacy and transparency safeguards:
-
Agentic Transparency (EU AI Act Article 50(1)): Our platform utilizes autonomous AI agents to interpret, break down, and structure natural language requests into technical solver parameters. Users are explicitly notified of this agentic interaction within our platform interfaces.
-
Synthetic Content Watermarking (EU AI Act Article 50(2)): Mathematical models, Python code, QASM scripts, and computational outputs generated by our AI agents embed machine-readable, detectable metadata to satisfy synthetic content provenance standards.
-
Upstream LLM Vendor Protections: Where natural language processing relies on third-party foundational LLM providers, SuperQ enforces strict enterprise Zero Data Retention (ZDR) agreements. Upstream vendors are legally and technically prohibited from storing, caching, or using SuperQ tenant data to train their foundational models.
-
Translation Audit Logging: To safeguard against algorithmic liability and ensure auditability, SuperQ maintains encrypted, isolated translation logs that map original user prompts to generated mathematical parameters. These logs are stored securely for diagnostic, security, and legal defense purposes and are completely isolated from AI training pipelines.
5. Regulatory Roles & High-Risk Deployments
-
Data Processor & AI Provider Status: SuperQ Quantum acts as a Data Processor under privacy laws and a Provider of a specialized optimization interface under the EU AI Act.
-
Client as the "Deployer": If a client integrates, deploys, or executes SuperQ platform outputs (including AI-generated scripts or models) within high-risk operational environments—such as energy grid management, critical infrastructure, supply chain logistics, or workforce allocation—the client acts as the sole "Deployer" under Article 26 of the EU AI Act. The client retains full responsibility for human oversight, bias monitoring, and conducting required risk or impact assessments.
6. Data Sharing and Disclosure
We do not sell, rent, or trade your personal or operational data to third parties. We share information only under the following strictly governed circumstances:
-
Service Providers & Sub-Processors: Vetted infrastructure hosts (e.g., secure cloud environments, quantum hardware providers) and LLM API vendors operating under strict confidentiality, security, and zero-retention contractual obligations.
-
Legal Authorities: Law enforcement or regulatory bodies when required by valid legal process, subpoena, or applicable legislation.
-
Corporate Transactions: In connection with a merger, acquisition, or sale of company assets, subject to the successor honoring this Privacy Policy.
7. Data Security & International Transfers
-
Technical Safeguards: We implement enterprise-grade security measures, including end-to-end encryption in transit (TLS 1.3) and at rest (AES-256), strict role-based access controls, and secure multi-tenant isolation.
-
International Data Transfers: SuperQ Quantum is based in British Columbia, Canada. Data collected globally may be processed in Canada, the United States, or the EEA. Cross-border transfers are conducted using recognized transfer mechanisms, such as Standard Contractual Clauses (SCCs) and Canada's PIPEDA adequacy status under EU law.
8. Your Privacy Rights
Depending on your geographic location, you may exercise specific statutory rights regarding your personal data:
-
Access & Portability: Request a copy of the personal data we hold about you.
-
Correction & Erasure: Request the correction of inaccurate data or the deletion of your personal information ("Right to be Forgotten").
-
Objection & Restriction: Object to or request restrictions on how we process your data.
-
Consent Withdrawal: Withdraw previously provided consent at any time without affecting lawful processing prior to withdrawal.
To exercise any of these rights, please contact us at support@superq.co.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect platform evolution, technical upgrades, or regulatory shifts (including ongoing enforcement phases of the EU AI Act). The latest version will always be indicated by the "Last Updated" date at the top of this page.
